Terms and Conditions of Purchase

Details of the terms and conditions of purchase of the www.wesselton.net website applicable exclusively to all sales made through this platform.

Use of the website www.wesselton.net or placing an order through it implies full acceptance of the Conditions of Purchase and Privacy and Data Protection Policies described here, which WESSELTON reserves the right to modify, with the applicable conditions being those in force at any given time.

1- General Information

In compliance with article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSICE), the company’s identification details are set out below:

The website www.wesselton.net operates under the name WESSELTON, which is the property of WESSELTON-SALA S.L, a company with tax identification number B17358656 and registered office at Avinguda S’Agaró 61 in Castell-Platja d’Aro, registered in the Girona Trade Register on page 1 of volume 526, sheet number GI-10257, contact telephone number: (+34) 972 816 753; contact email: online@wesselton.net.

The purpose of the company is the retail trade of jewellery, watches, silverware and jewellery, via the Internet or by any other means.

2- Description of the products

The detailed description of the products displayed on the www.wesselton.net website is based on WESSELTON’s own information and images (of which the company reserves all rights of use) and/or information and images supplied by suppliers.

WESSELTON is authorised to use the trade names or registered trademarks contained on the website.
The prices of published articles are subject to change.
The company is not responsible for possible errors in the information or characteristics of the products published.

3- Product availability

The availability of products on the website is updated according to stock. All product orders are subject to availability.
WESSELTON will not intentionally put more units on sale than are available from stock.
If, for uncontrollable reasons or undesired errors, WESSELTON puts a product on sale that is not available in stock and this product is purchased by a user, WESSELTON undertakes to act in good faith and offer the user the possibility of

  • To reimburse any amount that could have been paid without any penalty through the same means by which it was done.
  • Replace with another model of equal quality and value available in stock with the customer’s consent.
  • If there is a possibility of having the product available, send it in a new delivery time.

4- Price

The prices of the products presented on www.wesselton.net include VAT (percentage according to current legislation applicable at any given time) unless otherwise indicated.

Prices do not include shipping costs unless otherwise stated.
WESSELTON cannot be held responsible for any errors in the pricing of published articles. In the event of an error in the final price of any of the articles on display, WESSELTON undertakes to inform users of the new sales price as soon as possible, offering the customers concerned the possibility of reconfirming the order or of withdrawing from the purchase.
If it is not possible to contact the user, the order will be considered cancelled and the user will be refunded the amount of the wrong price paid. WESSELTON shall not be obliged to supply the purchaser with any product at the incorrectly lower price, even if the order is confirmed.

The prices of the articles published on the website are subject to change, but except for what has been established above, in the event of an error, any changes will not affect orders for which an order confirmation email has been sent.

5- Eligibility to make purchases

The user declares and guarantees to act in good faith by using this website only to make enquiries or place legally valid orders and not to acquire products through www.wesselton.net for the purpose of resale or parallel distribution for commercial gain.

If it can be assumed that a false or fraudulent order has been placed, WESSELTON reserves the right to cancel the order by paying the customer for the payment made without any penalty to WESSELTON.

By using this website, the user agrees to provide the information requested in a truthful and accurate manner, and agrees that WESSELTON may use this information to contact users if necessary. If the user does not provide all the information, the order cannot be processed.

By placing an order through the website, the user declares that he/she is of legal age and has the legal capacity to enter into contracts.

6- Methods of payment

WESSELTON provides users with a secure online payment gateway for credit and debit cards (Visa, Mastercard, Visa Electron and similar cards) offered by the Banc Sabadell entity.

By authorising the payment, the user is confirming that the credit or debit card belongs to him/her. Credit cards are subject to verification and authorisation by the card issuing institution. If the institution does not authorise payment, WESSELTON will not be liable for non-delivery or delayed delivery and the purchase will not be finalised.

WESSELTON undertakes under no circumstances to store sensitive information such as card numbers or authentication codes.

The possibility of payment by bank transfer or deposit is also offered under special conditions. In this case, WESSELTON reserves the right to delay the delivery of the purchase until the necessary collection guarantees have been provided.

The user undertakes to make full payment for the products purchased within the time set by the company.

7- Shipping and return policy

Order Formalization
Once the Conditions of Use and the purchase confirmation have been accepted, the customer will receive an order confirmation email with the details of the operation.
Method and delivery times.
Once the purchase has been confirmed, the delivery time will not exceed 15 working days and the usual delivery time will be less than 48-72 hours for shipments within the national territory from Monday to Friday.
The delay of the order will entitle the customer to cancel the order with a refund of the amounts paid, but in no case will it imply any compensation.

If the customer has not agreed a delivery date with the carrier within 5 working days of the order confirmation, the customer must contact WESSELTON. If the customer does not contact WESSELTON, the transport company will return the goods to the place of origin, and the customer will be responsible for the handling costs associated with the delivery and return.

 

Geographical scope
Jewellery products, classified under the “WESSELTON” brand, are not subject to geographical restrictions on distribution.
The distribution of the products of other brands of jewellery, watches or accessories may be limited geographically within the territory of Spain and/or the European Union, according to the specific specifications of each brand.
In the event that it is not possible to guarantee safe delivery of the products, WESSELTON reserves the right to restrict the geographical scope of distribution.

 

Shop pickup
If the customer wishes, they can pick up their order at the WESSELTON jewellery store at the following address, Avenida S’Agaró, 61 – Platja d’Aro. Tel. 972 816 753
To access the in-store collection service, the customer must indicate this during the purchase process and must comply with the delivery times indicated by e-mail.

 

Conditions of collection in shop:
The customer must go to the point of sale and identify himself/herself with the original valid ID or passport and show the proof of purchase.
If the customer wishes the products to be withdrawn by a third party, he must notify this by e-mail together with a signed authorisation containing the full details of the customer and the person he wishes to authorise (name, surname, ID or passport number).

 

Diligence in delivery
The customer undertakes to check the good condition of the shipment at the time of delivery to the carrier and must reflect any anomaly detected on the delivery note (broken packaging, external shocks, moisture, etc …) and may refuse delivery.
The customer must inform WESSELTON of any delivery incidents by email: online@wesselton.net
The delivery will be understood to have taken place or that the order has been delivered at the moment in which the user (or a third party on his behalf) acquires material possession of the product, which will be accredited by the signature of the receipt of the order at the agreed delivery address, if it is not “Shop collection”.

 

Right of dissent.
The customer acting as a consumer and user has the right to return the order within a period of less than 14 calendar days from the delivery of the order.
To return a product, the customer must contact WESSELTON and follow the instructions provided. Under no circumstances will returns be accepted that do not comply with the procedure and channels marked by the company.
The user will not have the right to cancel special or personalised orders.
Shipping and return costs will not be refunded.
They will not accept returns of products that have been tampered with or that have been used.
It is essential that the products to be returned keep the original packaging (box, documentation, accessories, etc).
Customized and/or personalized products will not be returned.
Once WESSELTON has notified you that the returned products meet the requirements of authenticity and condition, the payment will be refunded by the same method as the purchase and within a period of less than 15 working days.

 

Customs declaration and international taxes and fees.
All international shipments, as well as shipments to the Canary Islands, Ceuta and Melilla will be accompanied by an import/export declaration to the customs authorities. This document reflects the total amount of the order.
The Customer must pay any international taxes or fees that may be levied on the products in the collection territory.

8- Guarantee

In accordance with the provisions of Law 23/2003 of 10 July on Guarantees in the Sale of Consumer Goods, the manufacturer or brand name of the product purchased must respond to the customer for any lack of conformity due to manufacturing defects existing at the time of delivery and which become apparent during the following 2 years.

The deadline for the customer to notify any incident caused by manufacturing defects is 2 months from the time they become aware of it.
If the manufacturer of the purchased product checks and corroborates the existence of a manufacturing defect, it will repair or replace the item. Always at the customer’s choice, when technically possible and notified within the established deadlines.

Cases that will not be accepted as manufacturing defects:

  • General damage caused by improper or abnormal use of the product
  • Bumps and scratches caused by normal use of the product
  • Detachment or breakage of gems or other applied elements
  • Stains or changes in the shine of metals, gems or other elements caused by external chemical agents.
  • Allergies.

Specific cases for watch products that are excluded from the guarantee:

  • Battery life.
  • Wear and tear from normal use.
  • Damage caused by improper use of the product or lack of maintenance.

Any guarantee will be cancelled if the product is handled by personnel not authorised for this purpose by the manufacturer.
All other claims are excluded except for the rights of the buyer against the manufacturer under the law.

9- Data privacy policy

This website strictly complies with Organic Law 15/1999, of 13 December, on the Protection of Personal Data (LOPD), and with Royal Decree 1720/2007, of 21 December, known as the Regulations for the development of the LOPD. It also complies with Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of individuals (RGPD), as well as with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSICE or LSSI).

All the data requested through the website are necessary for the optimum provision of the services requested by the user. WESSELTON does not guarantee the correct provision of services if all the data requested in the registration and purchase process (including those marked as optional) are not provided.

Without prejudice to the purposes indicated in each case, the personal data requested will be stored and managed with due confidentiality, applying the computer security measures established in the applicable legislation to prevent access to or improper use of your data, its manipulation, deterioration or loss.

If you wish to exercise your rights of access, rectification, opposition, limitation, suppression, portability and not to be subject to automated decisions, you must send an e-mail to a:online@wesselton.net.En. If you have not obtained satisfaction in the exercise of your rights, you may file a complaint with the Spanish Data Protection Agency (aepd.es)

10- Prevention of money laundering and terrorist financing

Wesselton, due to its professional marketing activity of jewels, stones or precious metals, is bound by Law 10/2010 of 28 April, on the prevention of money laundering and financing of terrorism.

Among other obligations that are applicable to this condition, the client says and manifests that he is the real owner of the transaction, Wesselton must identify and keep a copy of the document proving the identity (ID card, passport, etc.) of any client who makes a purchase equal to or greater than 1,000 euros in jewellery products. This is in accordance with current legislation on the subject.

The Customer is aware of this legal obligation and undertakes to send, at Wesselton’s request, a copy of the certified identity document in order to comply with this obligation within ONE MONTH from the date of purchase.
WESSELTON reserves the right to hold the order until the customer has identified himself.

11- Modification of the purchase conditions

WESSELTON reserves the right to change the conditions set out here at any time and will publish them as they appear here. The validity of these conditions will depend on their exposure and will remain in force until they are modified by other duly published conditions.

12- Applicable Legislation

The use and purchase contracts through www.wesselton.net are governed by Spanish law.
Any dispute arising from these conditions of purchase shall be submitted to the jurisdiction of the Spanish courts
